Well, to address the clues, Brainiac 5 was in handcuffs on the cover of LSH # 273, and Chameleon Boy was on Takron-Galtos.
In addition, you could add Shrinking Violet, who was imprisoned until the beginning of TMK. Polar Boy TMK might not count as having been "criminal" since he was eventually acquitted thanks to Tenzil for the Defense. For that matter, Brainy was acquitted as well.
Post-boot, as someone mentioned, Brainy was imprisoned on Takron-Galtos too. As were, pre-boot, several Legionnaires sent by Universo, then impersonating President Kandru Boltax.
Speaking of Universo, he'd probably count for this question in the "Dynamo Boy/Lightning Lord/Saturn Queen/Cosmic King" sense. As might Tharok, who was briefly declared Legion leader, though it can perhaps be said that though he was leader, he was never a member.

From TMK LSH # 11, Tenzil for the Defense. Tenzil had Brek put on a fake big head and pretend to think that he's "Braino of Mrynah, the noblest being of all time." (hence my initial response). In a later panel we see that the back of the costume head says "Made in Winath."
Now, my question:
Why is it better to have Apollo's power than to be Charma's?
