Okay, so Brainy was so crap-all gung-ho on getting Star Boy expelled from the Legion way back when.

What made stupid Brainy think a super-heavy tree branch crushing Kenz Nuhor would be any LESS fatal that a ray gun blast?

Thom's expulsion was a mockery of justice!

I tittered with glee when Brainy was later court-martialed during the second Levitz/Giffen run.

I've wondered about the tree limb, too. I suppose it could be argued that the limb might have injured or even crippled Nuhor, while the gun blast was certain to cause his death. In other words, had death resulted from the tree limb, it could be ruled as unintentional.

Perhaps Quislet can provide the proper legal perspective.

You'll note that Brainy is currently getting creamed by Elastic Lad, of all people, over in the Battle for the Championship of the 31st Century.

Of course, his battle is taking place in Zerox, but still...

Makes you wonder if Brainy had a secret agenda when he got Thom kicked out. Jealousy? Was Star Boy blackmailing him? There were murky undercurrents in those stories!

What kind of tree was it? If it was a cartoon tree it probably wouldn't have killed anyone.

Still, everybody believed the green kid because he had the reputation of being the know-it-all.

Besides, whether or not tree limb could have killed Nuhor isn't really the issue. All Brainy had to do was convince the jury (e.g., his fellow Legionnaires) that there was an alternative to Thom's lethal action.

If he's stupid, what does that say about the Legionnaires who voted against Thom?

He Who Wanders has correctly pointed out the issue. I believe in the story, the Science Police cleared Star Boy of any wrong-doing in the death of Nuhor.

The Legion Constitution was holding Star Boy to a higher standard.

I think it really just an excuse to vote Thom out because nobody really liked him.

"Hey, Legionnaires! Let's all hook up to these groovy machines Command Kid designed! He says they'll give us greater powers!"

"Hey Legionnaires! I'm sponsoring this groovy new applicant, Dynamo Boy! I'm sure he'll be an great asset to the team!"

I don't know... Supergirl or Dream Girl? Supergirl seems less high maintenance at any rate.

Also, I believe it was established (by Jim Shooter's notes on the Legionnaires) that Thom was the "best equipped" guy Legionnaire, if you get my drift.

And he probably wasn't shy about bragging about it. I suppose that would have gotten old real fast.

I concur! I've always felt Brainy was pushing for Thom's expulsion way to hard in that story. Hmph, I guess turn-about was fair play when Brainy was on trial in the late Levitz days. Too bad Star Boy wasn't around to cast a vote against acquittal!

As for the other male Legionnaires, I can definitely see jealousy over Nura and OTHER issues as a factor. Slightly the opposite of the Legion femmes, who at the time voted against Star Boy's expulsion since they found his relationship with Nura so sweet! As I recall, Saturn Girl was the only female to vote against Thom. Hmph! She really was the tom-boy of the day.
